Item A case study of a land reform project in KwaZulu-Natal with reference to the Nkaseni Restitution Land Claim.(2010) Dlamini, Mzulu Alexandre.; Pillay, Pregala.; Govender, V.The primary aim of this research was to examine the processes involved in the implementation of land reform policies in South Africa with specific reference to the Nkaseni Land Restitution Claim in the Midlands of KwaZulu-Natal. The objective was to conduct an in-depth diagnostic study with a view to understanding the nature of the challenges, and to propose interventions that could improve land reform processes and the functioning of communal projects in the country. The hypothesis of this research was that the South African government's attempts at land reform have thus far failed to live up to expectations. Part of this research aimed to investigate this hypothesis using the Nkaseni Communal Project as a case study. A number of issues were identified as findings in this research and this report aims to present these issues. Through this study, the pillars of the land reform programme in South Africa were discussed as tenure reform, restitution and redistribution. While mention of the other land reform programmes was made, emphasis was placed mainly on the restitution policy which is the focus of this research. In this research, the experience of land reform in Less-Developed Countries such as Brazil, Kenya, Tanzania and China, has been reviewed. A lesson learnt from developing countries is that tensions and potential conflicts can hinder the process of land reform. It was also established that land reform is time-consuming, expensive and difficult. Some of the issues identified fall outside the mandate of the Department of Land Affairs, which recommends a clear framework for effective role-player participation with other government departments and other relevant stakeholders. A clear policy is needed on post-transfer support for land reform communal projects. This includes clarifying the specific roles, functions and powers of the different stakeholders. This study was also able to provide some evidence that there are numerous challenges that are being experienced by communal-managed projects that have been set up within the KZN Province. A number of the challenges emanate from poorly-drafted Constitutions of the Communal Property Institution as well as poor implementation of projects. The study was able to illustrate that land title can be transferred to the Communal Property Institutions, but that does not translate into the realization of secure individual rights of members of the institution. It was also noted that failure to address issues relating to individual rights allocation can be one of the major sources of conflict within Communal Projects. The research findings revealed that there was very little focus on empowering beneficiaries of communal projects to manage their newlyacquired resources once transfer of land had taken place. Also noted is that there was a lack of understanding of the Trust (as an institution) by some of the Trust members. Lack of co-operative governance was raised as a key issue hindering support from other stakeholders. The study revealed that there was a lack of systems or processes of dealing with multiple interests of Trust members. There was poor representation of women within decision-making structures. Lack of skills transfer to land reform beneficiaries is another contributing factor to the many challenges that are faced by the Communal Property Institutions. Beneficiary training and capacity building are key recommendations in the findings. From the start of the land reform programme, it was recognized that, given South Africa’s Agricultural history, transferring skills to beneficiaries was to be one of the key challenges and determinants of the land reform programme’s success. In the light of this study, a more integrated method of skills transfer at the community level would have many advantages, as it would help alleviate a number of the challenges currently experienced by the land reform projects. Lastly, the study also indicated that land reform beneficiaries were rarely experienced in making independent decisions. It is clear from this research that there is no blueprint approach to land reform, as each project should be designed for the particular conditions to be effective. The important aspects of both individual and communal tenure should be properly understood when reform initiative attempts to change social relations in rural areas are undertaken. There must be flexibility in policies regarding farm size, while support must also be given to proper training and extension aimed at increasing the individual farmer's managerial ability.Item Impact of urbanisation on municipal services delivery with particular emphasis on the provision of water in the Durban metropolitan area.(2000) Pillay, Pregala.; Moodley, Sathiasiven.The main aim of this thesis was to explore the impact of urbanisation on the provision of water to the people of the Durban Metropolitan Area. The literature study revealed that urbanisation is proceeding rapidly and that the urban population in Durban will continue to grow and expand. Employment opportunities and enhanced service delivery in urban areas were two of the primary factors that attracted people to the city centres. The provision of water was identified as a growing priority in the new South Africa. It was found that whilst the privileged minority enjoyed first world lifestyles, the majority of people were poverty stricken and had little or no access to basic services. The literature as it exists reflects that local government is entrusted with a mammoth and crucial task in enhancing sustainable service delivery at affordable prices to impoverished communities. In light thereof, local government required a concerted strategy to address urban needs if it is to respond more effectively to its clientele and to the effects of urbanisation in the new millennium. The empirical study included the use of questionnaires to: - managers at the Urban strategy Unit; - managers at Durban Metro Water Services; and - two hundred subjects randomly selected from the Inanda/ Phoenix, Cato Crest / Cato Manor, Clare Estate / Reservoir Hills and Umlazi informal settlements. The data was analysed using both descriptive and inferential statistics. The findings illustrates that an increase in urbanisation patterns has caused a decline in job opportunities and has added pressure to the local government infrastructure. The data revealed that the major obstacles to water delivery was accelerated urbanisation, lack of finance, high construction costs, high population growth rates, shortage of skilled labour, violence and crime and inadequate community participation. The empirical study revealed that people of all ages resided in the informal settlements. The majority of people were unemployed, generally had access to primary or secondary education and occupied menial jobs which were poorly remunerated. There is a need to create a National Commission on Urbanisation Development which can serve as an advisory body to government. This provision is universally recommended by urban geographers and government officials. This study calls for central government to play a more meaningful role in service delivery by strengthening the authority of local governments to raise adequate revenues to meet rising urban service needs. Central government must also provide technical assistance and training to local officials in improving tax administration, collection procedures and increasing revenues from existing and new sources. Local authorities need to improve their own performance in service delivery. This can be achieved if it has the capacity to act effectively and efficiently. Administrative structures and practices should be designed according to the services to be provided and the policies to be implemented. The ANC-led government aimed to be a people-centred one, and service delivery became the central focal point. For government to realise its goal of annihilating the inequalities of the past, it became imperative that services be provided in a transparent, coherent and representative manner to all citizens, particularly the previously marginalised communities. in order to promote efficiency, effectiveness, responsiveness and accountability, the government identified various alternative strategies that would enhance service delivery and bring it closer to the people. One of the strategies was to set up Multipurpose Community Centres (MPCCs), also known as Thusong Service Centres (TSCs), that were to serve as the vehicle to enhance service delivery. Although such a move was a noble one and brought hope to many impoverished South Africans, there are still challenges faced by government in the provision of basic services that culminated in recent violent service delivery protests that adversely affected the whole country. The purpose of the research was to determine if the establishment of the MPCCs as a vehicle in enhancing service delivery has made a difference in the lives of previously marginalized communities. This study, therefore, critically examines whether the already established Centres play a pivotal role in enhancing service delivery. The literature review revealed that successful public service transformation has to create a sound relationship between government and its constituencies, and that can be attained by meaningfully engaging the public in matters such as policy formulation, as such engagement will inform government on the kind of programmes to be initiated and implemented that will respond to the social and economic needs of citizens. It is crucial that government must be community owned so that citizens must not only see themselves as recipients of services but also as decision makers. The literature review further argues that government must recognise that its primary responsibility is to drive the delivery of services in an efficient, effective and economic manner. It is therefore crucial that public administrators be committed and accountable toward the community, expand customer choice of services, ensure that citizens get the best possible value for money, and that access to basic services is increased regardless of the locale. On the contrary, the empirical study revealed that the Centres are not effectively addressing the needs of communities. One of the reasons of the failure of these Centres is due to the fact that the establishment of some Centres there was lack of proper consultation with communities and other relevant stakeholders on what services need to be rendered. The study also revealed that some Centres do not have adequate physical and human resources, Centres are managed by managers that are not adequately trained in managerial skills. The study further revealed that lack of funding makes it impossible for these Centres and services rendered sustainable, and lack of communication and coordination of activities between departments utilising the Centres render integrated service delivery ineffective The research concludes by presenting recommendations that were carefully drawn from the analysis of the findings and the entire study, followed by a proposed model that provides a multifaceted approach that outlines an action plan in the delivery of services, and should serve as a guide to Government with regard to the implementation of strategies and policies for the betterment of lives of South African citizens, especially the previously marginalised.Item Organisational culture and values in the South African social security agency : a Batho Pele perspective.(2011) Dayaram, Vanitha.; Pillay, Pregala.Abstract not available.Item Student governance in higher education institutions in the Western Cape, South Africa [electronic resource] : a case study.(2011) Khan, Moonira Banu Mahomed.; Pillay, Pregala.The aim of this study was to explore the role and contributions of elected student leaders in student governance positions, at the four higher education institutions in the Western Cape. The literature study revealed that whilst information on student politics is easily available, very limited information is available about the elected student leaders in student governance positions in higher education institutions, within the broader governance framework. The role of elected student leaders in contributing to the democratisation of universities was positively identified as an indicator of the evolving democratisation of universities. It was found that whilst elected student leaders are involved in, and do contribute to key decision-making in policy matters, this is not always the case. Of significance is the quality of the deliberative process and the level of seriousness in connecting the voice of students in a meaningful and consistent manner, to institutional decision-making, on matters that affect students. The theoretical framework of this study was grounded in Public Administration theory, deliberative democracy theory and governance theory within a higher education institutional context. The study intersects with deliberative democracy theory in understanding the advantage of good student governance as a way of contributing to the democratisation of universities and the student and the public good. The role of student leaders is fore grounded by illuminating ways in which they interpret their student leadership roles and how they interpret this in relation to the national and institutional policy framework referred to in the National Plan for Higher Education (Republic of South Africa, 2001). The policy context provides a basis for understanding the relationship between Public Administration and higher education. The Higher Education Act, No. 101 of 1997, provides the legislative framework for institutional governance, within which the statutory provision for student governance is situated. In particular, the Higher Education Act sets out the framework for institutional student governance and principles of good governance. The governance ethos of the Higher Education Act is derived from principles of good Public Administration as the basis for good governance, and the democratic values and principles as set out in Section 195 of the Constitution of the Republic of South Africa, 1996. An empirical study was conducted which included the administration of questionnaires to students in student leadership positions at the four universities in the Western Cape. In addition to the questionnaire survey, interviews were conducted with students and staff. The data was analysed statistically, using descriptive statistics. The findings of the study illustrate support for the continued existence of the student governance framework and for the role of student leaders in the decision-making processes of higher education institutions. However, there is a need for a more serious and consistent commitment to involving students in deliberative processes on matters of student interest and the public good. Such involvement is fundamental to the values and principles of democracy and good governance. The challenge for change is to seek meaningful and sustainable ways to complement the student governance approach by drawing in and connecting the broader student voice to the representations and the decision-making processes on its behalf by those who represent them, and by the decision-makers. It may be useful to review the role of student leaders in how this role is interpreted and deployed by the student leaders and how this role is supported by staff and the decision-makers involved in decision-making that impact on students. This descriptive study explored key factors such as the role and contributions of student leaders in governance positions, their functions, skills and applications deployed within their specific environment of student governance, and the general institutional governance environment and its influences on institutional democratisation. The research study culminates in providing guidelines for an integrated student governance framework in contextualising and supporting a wider deliberative student governance approach in higher education. This requires commitment and support from the management and student leadership, in pursuit of effective student governance within an environment that is nurturing and embracing of the student voice as central to achieving the institutional vision.
